MADISON, WI (WSAU) — A Merrill man is accused of illegally storing electronic waste at facilities in Wisconsin and Tennessee.
A federal grand jury in Madison has indicted Kevin Shibilski for storing and disposing of hazardous waste without a permit. Shibilski, the CEO of 5R Processors, LTD, is accused of taking over 8 million pounds of crushed glass from CRT devices including old TVs and computer monitors then failing to recycle them properly.
The CRT glass is considered toxic because it contains lead.
The 59-year-old is also accused of wire fraud for taking more than $5.75 million in fees from customers without recycling the items. Additionally, he’s accused of evading federal tax laws by failing to submit more than $850,000 in employment and income taxes for employees of 5R Processors.
Shibilski could be sentenced to more than 30 years in federal prison if found guilty on all counts.
Three other individuals including 61-year-old James Moss of Ladysmith have been charged as conspirators in the case. Moss also faces a count of tax evasion and has reached a plea deal with prosecutors. His sentencing is scheduled for November 13th in US District Court in Madison.
